====================================================== CORAM: HONOURABLE MR. JUSTICE AHSANUDDIN AMANULLAH ORAL ORDER 05-09-2016 Nobody appears on behalf of the petitioner. On 13.05.2015 also nobody had appeared and the Court had issued notice to the petitioner calling upon him to show cause as to why provisional bail granted to him be not cancelled. From the office notes, it appears that the brother of the petitioner has received the show cause notice. In view of the aforesaid, the notice having been validly served and still nobody appearing for the petitioner, the Court is left with no option but to cancel the provisional bail granted to the petitioner on 11.12.2014. The court below is directed to cancel the bail bonds of the petitioner and take him into custody on the next date fixed in the case. In case the petitioner evades to surrender, all coercive measures shall be taken for him being taken into judicial

Patna High Court Cr.Misc. No.39493 of 2014 (5) dt.05-09-2016 2/2 custody. The court below, if required, may inform the Superintendent of Police, Nalanda for apprehending the petitioner. In such event, the Superintendent of Police, Nalanda shall ensure that the petitioner is arrested and produced before the court below expeditiously.

The order be communicated to the court below as well as the Superintendent of Police, Nalanda through fax also latest by day after tomorrow.

The application stands disposed off.

However, the court below shall submit a report with regard to the compliance of this order latest within two months from today. If such report is not received or discloses that the petitioner has not been taken into custody, the Office shall place the matter before the Court immediately.
