====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 21-12-2021 Heard the learned counsel for the petitioner and the learned APP for the State.

The petitioner seeks bail in anticipation of his arrest in connection with Abadpur P.S. Case No. 14/2020 instituted for the offences under Section 147, 148, 149, 323, 341, 307, 353, 332, 333, 427, 436 and 120-B of the Indian Penal Code.

As a protest against the arrest of one Md. Mohsin, several persons including the petitioner assembled at the police station and resorted to arson and looting. They are alleged to have damaged the vehicles parked in the premises of the police station. 48 persons have been

The learned counsel for the petitioner has submitted that his name has been taken by some of his enemies. The petitioner was not even available in the locality when the occurrence is said to have taken place. No specific act of exhorting the crowd or participating in the riotous behaviour has been attributed to the petitioner. Some of the other accused persons having similar allegation have been granted anticipatory bail. The petitioner is a person of clean antecedents.

For the reasons afore-stated, the petitioner, above named, is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate -1st Class, Katihar, in connection with Abadpur P.S. Case No.
