2 The petitioner apprehends arrest in Sasaram (M) PS Case No 1476 of 2017 registered for the offence punishable under Sections 302, 379, 120B/34 of Indian Penal Code and Section 27 of Arms Act.
3 As per the prosecution case, the informant's husband left in Scorpio vehicle and after sometime, she came to know that her husband has been killed. Petitioner is alleged to be one of the conspirators.
4 Learned counsel for the petitioner submits that due to previous enmity with the deceased, he has been made accused
Patna High Court CR. MISC. No.33404 of 2023(3) dt.05-09-2023 2/2 in this case. There is no allegation of any overt act or causing firing against this petitioner. He is only alleged to be conspirator. Petitioner has got two criminal antecedents in which he is on bail.
5 Learned APP has vehemently opposed the prayer for anticipatory bail.
6 Considering the rival submissions, in the event of arrest/surrender within a period of six weeks from today, the petitioner above named be enlarged on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Rohtas at Sasaram in Sasaram (M) PS Case No 1476 of 2017 subject to the conditions as laid down in Section 438 (2) of the Code of Criminal Procedure.
