====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 14-05-2026 Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. Petitioners seek regular bail in connection with Pastpar P. S. Case No. 23 of 2024 registered for the offences punishable under Sections 126(2), 115(2), 118(2), 303(2), 109, 333, 352, 351(3), 3(5) of the Bharatiya Nyaya Sanhita to which Section 103(1) BNS was added later on.
3. As per the prosecution story, the informant alleged that on 05.09.2024, the accused persons including these petitioners, variously armed, forced themselves in the house of the informant and on the order of co-accused Kailash, Murari, Digambar and Satyam started assaulting by the country made pistol. Further omnibus allegation is against others of assaulting
Patna High Court CR. MISC. No.31529 of 2026(2) dt.14-05-2026 2/2 the family members who all become unconscious. They were shifted to Primary Health Centre, Patarghat and then to Saharsa/Madhepura. During the course of the treatment, the father of the informant namely Maheshwar Yadav died.
4. Learned counsel for the petitioners submits that from bare perusal of the F.I.R. it is evident that specific allegation is against Kailash, Digambar, Satyam and Murari. Allegation against petitioners is general and omnibus and there is no allegation of any specific overt act against them. Petitioners are in custody since 25.01.2026 and charge-sheet has already been submitted.
5. Learned A.P.P. for the State vehemently opposed the bail application.
6. Considering the nature of allegation and period of custody, the bail application is allowed. Let the above named petitioners be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saharsa in connection with Pastpar P.
