JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 28-08-2019 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Kishanganj P.S. Case No. 579 of 2018, registered for the offences punishable under Sections 302, 353, 333 and 34 of the Indian Penal Code and section 27 of the Arms Act.

Prosecution case is that some miscreants entered into the house of informant, committed dacoity and exploded bombs. Four persons including this petitioner were apprehended by the villagers and handed over to the police.

It is submitted on behalf of petitioner that nothing has been recovered from possession of the petitioner. Petitioner is in custody since 13.09.2018 having no criminal antecedent. Other co-accused has been granted bail by a Coordinate Bench of this court vide order dated 22.05.2019 passed in Cr. Misc. No.

Patna High Court CR. MISC. No.34645 of 2019(3) dt.28-08-2019 2/2 24413 of 2019.

Considering the facts aforesaid, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000 (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kishanganj in connection with Kishanganj P.S. Case No. 579 of 2018.
