JUSTICE RAJESH KUMAR VERMA ORAL ORDER 08-12-2023 Heard Mr. Baidya Nath Thakur, learned counsel for the petitioners and Dr. Indiwar Kumari, learned A.P.P. for the State. This application has been filed for modification of the order dated 22.09.2022 passed in Cr. Misc. No. 33093 of 2022 by which the petitioner had been granted bail by this Court. Learned counsel appearing for the petitioner submits that the petitioner has been granted bail vide order dated 22.09.2022 with one of the condition that; Petitioner shall cooperate in the trial and shall be properly represented on each and every date fixed by the court and shall remain physically present

Patna High Court CR. MISC. No.75288 of 2023(3) dt.08-12-2023 2/2 as directed by the court and on his absence on two consecutive dates without sufficient reason, his bail bonds shall be cancelled by the Court below.

He further confined his prayer to modify the condition as aforesaid in view of the fact that the petitioner has suffered internal stomach bleeding for which he was thrice operated and he has to undergo regular treatment in Hyderabad and Assam. Therefore, the condition as aforesaid may be modified to the extent that the petitioner shall be physically present before the court below as and when required in the Court. In view of the submission, order dated 22.09.2022 passed in Cr. Misc. No. 33093 of 2022 is modified to the aforesaid extent.
