2. Both accused/petitioners are named in the FIR and apprehending their arrest in connection with Nadi P.S. Case No.26 of 2025 registered under Sections 103(1), 238 and 3(5) of the Bharatiya Nyaya Sanhita, 2023 (in short 'BNS').
3. The allegation against the petitioners is to involve in committing murder of the daughter of informant along with other named co-accused persons.
4. It is submitted by learned counsel for the

No.33653 of 2026(3) dt.21-07-2026 2/3 petitioner that as per FIR, it can be safely gathered that when daughter of informant was apprehended with Birbal Kumar by the son of informant, namely, Dinkar Kumar and his friends namely, Bikesh Kumar and Neeraj kumar, just to save her social face, the daughter of the informant committed suicide. It is submitted that during investigation and supervision of this case, the allegation was found true for the offence punishable under Section 108 of the BNS. It is submitted that as per FIR, the maximum allegation appears against these petitioners is to help in concealing dead body or to perform last rites of deceased near the bank of river Ganga along with other co-accused persons without any active participation in any abetment or in actual commission of crime. It is submitted that petitioner no. 1 is a tractor owner who was engaged to carry the dead body and the petitioner no. 2 is a co-villager having no specific allegations even of concealing the dead body.
5. Learned APP opposed the prayer of bail.
6. In view of aforesaid factual submissions and by taking note of fact as FIR prima facie failed to suggest any

No.33653 of 2026(3) dt.21-07-2026 3/3 active involvement of petitioners qua actual crime in question or the abetment to commit suicide coupled with the fact that the petitioners are alleged with limited allegation being tractor's owner and co-villagers as to assist in concealing the dead body or performing the last rituals of daughter of the informant, accordingly, both petitioners, above-named, are directed to be released on bail, in the event of their arrest or surrender in the court below within a period of four weeks, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Naugachia, in connection with Nadi P.S. Case No.26 of 2025, subject to the conditions as laid down under Section 438(2) of the CrPC/under Section 482(2) of the BNSS.
