The petitioner apprehends his arrest in Laxmipur P.S. Case No.332 of 2018 registered under Sections 420, 467, 468, 471, 120B of the Indian Penal Code.
The gist of the allegation against the petitioner is that the petitioner give 20 marks as weightage on the certificate issued by the competent authority to Diwakar Chaurasia. The learned counsel for the petitioner submits that the petitioner imparted education at Lok Seva Kendra and the Principal Secretary, Human Resources Development Department vide Annexure-2 issued directions to grant weightage to such candidates who imparted education on different Kendras. On the basis of which the District Education Superintendent directed the petitioner to grant weightage to
Patna High Court Cr.Misc. No.75788 of 2018(2) dt.21-12-2018 2/2 Diwakar Chaurasia.
Mr. Ajay Mishra, learned counsel for the Vigilance opposed the prayer for bail but it appears that the petitioner and Mukhiya granted weightage on the basis of the instruction of the Principal Secretary and the certificate issued by the District Education Superintendent.
Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri S.K.Singh, J.M. 1st Class, Jamui in connection with Laxmipur P.S. Case No.332 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
