JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-05-2019 Petitioners seek bail in anticipation of their arrest in connection with Jakkanpur P.S. Case No. 147 of 2019 registered for the offences punishable under Sections 147, 149, 341, 323, 332, 353, 224, 504, 506 of the Indian Penal Code and Sections 45 and 30A of Bihar Prohibition and Excise Act. Prosecution story is that police party raided the CID club, Karbighiya in order to arrest Bhallu Kumar @ Golu Kumar (petitioner No.1) and the accused persons who are

No.32524 of 2019(2) dt.16-05-2019 2/3 family members of petitioner No.1 attacked the police party and started fleeing away with the liquor and also given threat to police party to implicate in a case of outraging modesty. Submission of learned counsel for the petitioners is that the allegation is false and concocted and petitioner Nos. 4, 5 and 6 are ladies and they are ready to abide by any condition that may be imposed on them.

In view of above facts and circumstances, let petitioner Nos. 4, 5 and 6, in the event of arrest or surrender before the court below within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Special Judge, Excise, Patna, in connection with Jakkanpur P.S.Case No. 147 of 2019, arising out of Special Case No. 2857 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned and further condition is that they have to co-operate in the investigation.
