JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 13-12-2021 Heard learned counsel for the petitioner and the State. The petitioner seeks regular bail registered for the offences punishable under section 392 of the Indian Penal Code. As per the prosecution case, while the informant was going on motorcycle this petitioner and two others on the point of pistol snatched his cash, Laptop and fled away. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioner. There is no eye witness of the occurrence. No substantive evidence has been collected during course of investigation to suggest the implication of this petitioner in the present case. Petitioner is in custody since 3.3.2021.

Patna High Court CR. MISC. No.42215 of 2021(3) dt.13-12-2021 2/2 Learned counsel appearing for the State opposes the prayer for bail. He submits that the informant has identified the petitioner while committing the offence of loot. He has criminal antecedent.

Considering the nature of accusation against the petitioner as well as the fact that the petitioner has been identified by the informant and has criminal antecedent, his prayer for bail is refused.
