2. The petitioner apprehends his arrest for the offences alleged under Sections 498(A) of the Indian Penal Code and Section 4 of the Dowry Prohibition Act registered in connection with Complaint Case No. 2882 of 2017.

3. It is submitted that the petitioner has been falsely implicated and as a matter of fact it is the opposite party no. 2 who does not desire to live with the petitioner as evident from her statement before the learned Court below. The petitioner has filed Case No. 197 of 2017 dated 28.11.2017 for restitution of conjugal rights, pending in the Court of learned Principal Judge,

Patna High Court Cr.Misc. No.77119 of 2018(3) dt.24-01-2019 2/2 Chapra, Saran. The petitioner claims clean antecedents.

4. None appears on behalf of the complainant when the matter is called.

5. Having regard to the entirety of the facts and circumstances of the case, the provisional anticipatory bail granted to the petitioner by order dated 16.01.2019 pending in the Court of Sub-Divisional Judicial Magistrate, Chapra, Saran in connection with Complaint Case No. 2882 of 2017 is hereby confirmed.
