JUSTICE CHANDRA SHEKHAR JHA ORAL ORDER 24-06-2023 Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State. The petitioner seeks bail in connection with Parasbigha P.S. Case No. 319 of 2022 registered for the offence under Sections 304-B/34 of the Indian Penal Code. The accused/petitioner is named in the F.I.R. and is in custody since 17.11.2022.
The allegation against the petitioner is to cause death of sister of the informant alongwith other co-accused persons/family members due to non-fulfillment of demand of dowry as raised for cash of Rs. 5,00,000/- (Rupees Five Lac Only) and golden chain.
Learned counsel appearing on behalf of the petitioner submitted that petitioner is married sister-in-law and living

No.33484 of 2023(2) dt.24-06-2023 2/3 separately in different village much prior to this occurrence and, as such, having no connection with daily and domestic affairs with deceased and her husband. It is submitted that implication is only out of relations as petitioner is sister-in-law of deceased. It is pointed out that during the course of investigation, save and except general and omnibus allegation, nothing surfaced against this petitioner where sister of informant committed suicide out of matrimonial discord. While concluding the argument, it has been submitted that petitioner is a lady of clean antecedent and moreover, investigation has been completed, for which, chargesheet has been submitted, as such, there is no chance of tampering with the evidence.
Learned APP opposes the prayer of bail.
Considering the facts and circumstances as mentioned above and by taking note of the fact as petitioner is married sister-in-law of deceased, prima facie, living separately, who is a lady of clean antecedent coupled with the fact that chargesheet has been submitted, where petitioner is in custody since 17.11.2022, accordingly, the petitioner, above named, is directed to be released on bail in connection with Parasbigha P.S. Case No. 319 of 2022 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the
