2. The petitioner apprehends his arrest in a case registered for the offence under Section 409, 420 of the Indian Penal Code.

3. It is alleged that irregularity was committed in implementation of government scheme under the "Gramin Payjal Nischay Yojna" and "Gramin Gali Pakkikaran Yojna" wherein after the inquiry, it was found that though money was withdrawn under the aforesaid government scheme by the concerned person, but the work in question is incomplete.

4. It is submitted on behalf of petitioner that petitioner, at the relevant time, was posted as ward secretary and he has got no role in implementation of government scheme. Moreover, the work in question has already been completed. In

Patna High Court CR. MISC. No.33503 of 2023(3) dt.08-08-2023 2/2 support of this submission, learned counsel for the petitioner has annexed copy of statement of Patna Collectorate, Patna (Annexure - 3). Some of the similarly situated co-accused persons have already been granted anticipatory bail by this Hon'ble Court. Petitioner has got clean antecedent.

5. Learned A.P.P. for the State has opposed the bail petition.

6. Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM VI, Patna City, Patna in connection with Gaurichak P.S. Case No. 597 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
