The petitioners seek regular bail in connection with Special Case No.3364 of 2019 arising out of Phulwari Sharif P.S.Case No.303 of 2019 registered for offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016.
Allegation against the petitioner is of recovery of 33.750 ltrs. of liquor from the outside of the house of the petitioners . Petitioners are named in the FIR.
Submission of the learned counsel for the petitioners is that they have no criminal antecedent and nothing has been recovered from their house or from their possession. They are
Patna High Court CR. MISC. No.30523 of 2019(2) dt.23-05-2019 2/2 in custody for two months.
Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Act, Patna in connection with Special Case No.3364 of 2019 arising out of Phulwari Sharif P.S.Case No.303 of 2019. With the above direction, this application is allowed.
