JUSTICE SANJAY PRIYA ORAL ORDER 3/ 26-06-2018 This application under Section 482 of the Code of Criminal Procedure has been filed for quashing of First Information Report of Purnea Sadar P.S. Case No.72 of 2015 instituted for the offence under Section 135 of the Electricity Act and Section 420 Indian Penal Code.
None appears on behalf of the petitioner.
Counsel for the NBPDCL as well as State are present. They have submitted that in the instant case police has submitted charge-sheet and cognizance has already been taken. Case is pending for framing of Charge.
A report was called for from the Court below with
Patna High Court Cr.Misc. No.37427 of 2015 (3) dt.26-06-2018 2/2 regard to present stage of the case, which has been received, from which it appears that the case is pending for framing of Charge against the accused.
In view of such, the charge-sheet has been submitted after completion of investigation and case is pending for framing of Charge.
This application is, accordingly, dismissed.
The Court below will proceed with the case in accordance with law.
