ANJANA MISHRA ORAL ORDER 17-10-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is in custody since 01.12.2018 in connection with Deoriya P.S. Case No. 95/2018 registered for the offence punishable under Sections 395 of the Indian Penal Code.
Learned counsel for the petitioner submits that the name of the petitioner figured in the confessional statement made before the police by one Deepak Kumar who has also taken the name of other co-accused persons. It is further submitted that till date, the petitioner has not been placed on T.I. parade nor has there been any recovery from his possession. Learned counsel for the petitioner submits that other co-accused who were also similarly named by the co-accused Deepak
Patna High Court CR. MISC. No.34256 of 2019(4) dt.17-10-2019 2/2 Kumar have since been extended the privilege of bail in Cr. Misc. No. 8441/2019, Cr. Misc. No. 76930/18, Cr. Misc. No. 9623/19, Cr. Misc. No. 11450/2019 and Cr. Misc. No. 15159/2019 on 13.02.2019, 20.12.2018, 18.02.2019, 26.02.2019 and 12.03.2019.
Considering the aforementioned facts and circumstances, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 13th Additional Sessions Judge, Muzaffarpur, in connection with Deoriya P.S.
