Petitioner apprehends arrest in a case registered for the offence punishable under Sections 307, 506/34 and other allied sections of Indian Penal Code.
As per prosecution case, all the FIR named persons including this petitioner gave lathi blow over the head of informant as a result of which he sustained injury. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Moreover, injury allegedly caused by the petitioner has been found to be simple in nature by the doctor. Petitioner has got clean antecedent.
Considering the nature of injury and clean antecedent
Patna High Court CR. MISC. No.33422 of 2022(2) dt.15-11-2022 2/2 of the petitioner, let the above named petitioner in the event of his arrest/surrender before the court below within a period of thirty days from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Jamui in Laxmipur (Gidhaur) P. S. Case No. 41 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
