The petitioner seeks bail in Kotwali P.S. Case No.33 of 2020, registered for the offence under Section 302,201,353,203,177,182,195 of the Indian Penal Code. As per the F.I.R., some unknown persons killed the son-in-law of informant, however; during course of investigation, this petitioner has been made accused in this case. It is submitted on behalf of petitioner that petitioner has been falsely implicated in this case only due to the fact that the dead-body of deceased was found in front of the house of petitioner. Petitioner has got clean antecedent and he is in custody since 25.01.2020.

However, learned A.P.P. for the State opposed the bail

Patna High Court CR. MISC. No.42237 of 2021(4) dt.13-01-2022 2/2 petition and submitted that during course of investigation, it has come that blood-stained cloth of deceased was found inside the house of the petitioner. Apart from that ample material has come during course of investigation, which shows complicity of petitioner in the aforesaid crime.

Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner and same is, accordingly, rejected. However, considering the fact that petitioner is in custody since 25.01.2020, the learned trial court is directed to expedite the trial.
