The petitioner being brother of the husband of the informant's daughter is apprehending arrest in a case registered for the offences punishable under Sections 498A,323,341,342,324,326 and 307/34 of the IPC and Sections 3 and 4 of Dowry Prohibition Act.
The prosecution case as per the written report of Satyanand Sinha submitted to the SHO, Laheriasarai Mahila Police Station is to the effect that the informant's daughter, namely, Deepanjali Anand was married with co-accused Jitendra Kumar on 30.11.2016. Subsequent to the marriage, a further dowry demand of an A.C. and Rupees Six Lacs were made and due to the non-fulfillment of the same physical and mental torture was inflicted on her. Patna High Court Cr.Misc. No.70712 of 2018(2) dt.18-12-2018 2/2 to the in-laws house by her husband and on 3.3.2018 all the five accused persons tried to set her on fire.
It is submitted by learned counsel for the petitioner that the thrust of accusation is against the husband of the victim. The injury has been found to be superficial and simple in nature. It is further submitted that co-accused Madhuri Devi (mother-in-law) has been granted regular bail vide Cr. Misc. No. 26866 of 2018 whereas co-accused Neha Kumari has been granted anticipatory bail vide Cr. Misc. No. 65194 of 2018.
Considering the accusations being omnibus and general against the petitioner and similarly situated co-accused being granted bail, let the petitioner above named be released on anticipatory bail in the event of arrest or surrender within 12 weeks on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Darbhanga in connection with Mahila P.S. Case No.17 of 2018 subject to the conditions laid down in Section 438(2) of the Cr.P.C.
