28-10-2021 Heard learned counsel for the parties.

The petitioner seeks bail in Amarpur P.S. Case No. 587 of 2020, registered for the offence under Sections 302/120(B)/34 of the Indian Penal Code and Sections 25(1b)/26/35 of the Arms Act. As per the prosecution case, on 21.09.2020 (night), while the son of informant was returning home, the petitioner and other FIR named co-accused committed his murder. It is further alleged that prior to the occurrence, this petitioner had threatened the deceased with dire consequences. It is submitted on behalf of petitioner that due to old enmity between the informant and his elder brother Siyaram Yadav, the alleged occurrence took place and petitioner is sonin-law of Sanjiva Yadav, who is the son of Siyaram Yadav, and

Patna High Court CR. MISC. No.42246 of 2021(2) dt.28-10-2021 2/2 due to this fact, petitioner has been falsely implicated in this case. Informant is not the eye-witness of the occurrence. Petitioner has got clean antecedent and he is in custody since 08.01.2021. Investigation is complete.

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Amarpur P.S.
