The petitioner is languishing in custody since 04.06.2014 in a case registered for the offences punishable under Sections 341, 323, 337, 448, 307 and 504/34 of the Indian Penal Code and then charge-sheet has been submitted under Section 304/34 of the Indian Penal Code.

In the background of a dispute for selling the share of land of the accused persons the petitioner and others assaulted the uncle of the informant, namely, Moti Yadav. Though the informant and his cousin brother Shivdani were also assaulted but Moti Yadav died after 55 days of the receiving the injuries. Considering the fact that the injury was

No.38700 of 2014 (03) dt.06-02-2015 2/2 initially found simple, the charge-sheet has been submitted under Section 304/34 of the IPC and similarly situated co-accused Mulo Yadav has been granted bail vide Cr. Misc. No. 42829 of 2014, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Munger in connection with Dharahara P.S. Case No. 148 of 2013.
