The petitioners are apprehending their arrest in connection with Goural P.S.Case No.238 of 2017 , registered for offences punishable under Sections 366/34 of the Indian Penal Code.

Allegation as per FIR is that the daughter of the informant was traceless and later on he came to know that the petitioners and others have enticed her away and it is also alleged that the petitioner no.3 was talking with victim earlier to that.

Submission of the learned counsel for the petitioners is

Patna High Court CR. MISC. No.70572 of 2018(6) dt.17-06-2019 2/2 that as a matter of fact she has love affair with another coaccused and she fled away with him and the petitioners have falsely been implicated in this case, though there is no evidence against the petitioners that they have participated in kidnapping. Earlier they had been granted provisional bail and they are still ready to abide by any condition imposed upon them.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, this application is allowed with condition to the petitioner to co-operate in the investigation and the provisional bail granted, vide order dated 15.01.2019 is affirmed.
