JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-01-2021 Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 28.10.2019 in connection with Saharsa P.S. Case No. 964 of 2019 registered for the offences punishable under Sections 25(1-b)a, 26 and 35 of the Arms Act .

Although, the prayer for bail of the petitioner was, earlier, rejected by a Co-ordinate Bench of this Court vide order dated 20.1.2020 passed in Cr. Misc. No. 2911 of 2020 taking note of criminal antecedents of the petitioner but the said Coordinate Bench of this Court, while rejecting the bail prayer of the petitioner kept in mind the period of custody of the petitioner and that is the reason, the Co-ordinate Bench of this Court observed that the bail petition of the petitioner is being

Two firearms and ten cartridges are said to have been recovered and petitioner does have criminal antecedents of seven cases but uptil now, charge against the petitioner could not be framed. Therefore, considering the period of detention of the petitioner as well as stage of the trial, I think it proper to release the petitioner on bail and, accordingly, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in connection with Saharsa P.S.
