2. The petitioner apprehends her arrest in a case registered for the offence under Sections 304(B), 428, 34 of the Indian Penal Code.

3. As per allegation made in the F.I.R., this petitioner alongwith other family members committed torture to the daughter of the informant due to non-fulfillment of demand of dowry and ultimately, killed her by administering her poison.

4. Petitioner happens to be sister-in-law (xksruh) of the deceased. There is general and omnibus allegation against him. Thrust of accusation is against husband of the deceased, who has already been granted regular bail by the learned Court below itself. Petitioner is separate in mess and property and has got no concern with the affairs of couple. Similarly situated co-accused

Patna High Court CR. MISC. No.33316 of 2023(3) dt.28-07-2023 2/2 Kirani Kumar @ Kirani Prasad (husband of this petitioner) has already been granted anticipatory bail by a coordinate Bench of this Court, vide order dated 09.12.2022 passed in Cr.Misc. No. 42998 of 2022.

5. Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

6. Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Hilsa, Nalanda in connection with Hilsa P.S. Case No. 397 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
