In this case, the petitioner is seeking regular bail in connection with Dinara P.S. Case No. 350 of 2018, registered for the offence under Sections 302, 201/34 of the Indian Penal Code and under Section 27 of the Arms Act.
As per the F.I.R., on 14.09.2018 the father of the informant, after taking meal, had gone to sleep in the Dalan. In the next morning, his father was not there in the Dalan, therefore, the informant made search of him, in the meantime, he got information that a dead body is lying in Badhar at village - Nisi, P.S.- Dinara, District- Rohtas, then the informant went there and found that the dead body of his father. It has also been alleged that the mobile phone of the father of the informant was also missing. The name of the petitioner has come during
Patna High Court CR. MISC. No.32828 of 2020(4) dt.08-01-2021 2/2 investigation on the statement of co-accused Lakshman Chaudhary @ Lakshan Chaudhary.
Learned counsel for the informant submits that coaccused Lakshman Chaudhary @ Lakshan Chaudhary has been granted bail by a co-ordinate Bench of this Court in Criminal Miscellaneous No.3692 of 2019 vide order dated 30.01.2019 inasmuch as, other co-accused persons namely Bhalu Pal @ Pradip Kumar Pal and Rajesh Chaudhary have also been granted bail by a co-ordinate Bench of this Court in Criminal Miscellaneous No.53385 of 2019 vide order dated 25.11.2019. He further submits that the petitioner is in custody since 01.04.2019.
Considering the aforesaid facts and circumstances of the case, let the petitioner, above-named, be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Bikramganj, Rohtas at Sasaram, in connection with Dinara P.S.
