JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-01-2021 Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 11.8.2020 in connection with Khagaria P.S. Case No. 566 of 2020 registered for the offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016.

Although, it is alleged that petitioner was caught with 54 litre English liquor but submission on behalf of the petitioner is that the alleged recovery has not been made from conscious possession of the petitioner.

No doubt, the petitioner does have criminal antecedent but considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount
