Let the defect(s) be removed within two weeks of the complete start of the physical Court in normal course. The petitioner, who is in custody since 29.02.2020 seeks bail in connection with Sessions Trial No. 128 of 2020, arising out of Punaura P.S. Case No. 32 of 2020, registered for the offence punishable under Sections 304(B)/34 of the Indian Penal Code, pending in the Court of learned Addl. Sessions Judge-XI, Sitamarhi.
Taking into consideration the serious nature of allegation made against the petitioner, who is the husband, is that he strangulated his wife to death. The allegation is supported by the opinion of the Doctor that the deceased died due to asphyxia leading to CR failure as a result of throttling. I
Patna High Court CR. MISC. No.43558 of 2021(3) dt.23-03-2022 2/2 am not inclined to enlarge the petitioner on bail, at this stage. Accordingly, the prayer for grant of regular bail is rejected. However, the learned trial Court is directed to conclude the trial, expeditiously, well within a period of six months. If no substantial progress takes place in trial, the petitioner, if so advised, may renew his prayer for bail after six month.
