KUMAR ORAL ORDER (Per: HONOURABLE THE CHIEF JUSTICE) 18-02-2020 Petitioner has prayed for following reliefs:- "I. Direction to the respondent authorities to ensure that Ayurvedic Colleges of Begusarai, Darbhanga, Bhagalpur and Buxar get recognized by CCIM so that health facilities could be provided to the residents of those localities and medical education could also be started.

ii. To direct the respondent authorities to

Patna High Court CWJC No.3095 of 2017(18) dt.18-02-2020 2/3 ensure that all the AYUSH Hospitals/Primary Health Centers and AYUSH dispensaries get functional in the State of Bihar where the facilities of treatment is not available due to non-availability of doctors, para-medical staffs and equipments, drugs etc.

iii. To direct the respondents to implement the Rule 2010 which provides for creating and functioning of separate directorate of each wing of the AYUSH directorate.

iv. Any other releif or reliefs which the petitioner may be found entitled to."

The issue pertains to implementation of the centrally sponsored scheme titled as AYUSH.

From the supplementary affidavit dated 10.08.2018 filed on behalf of the respondent which is taken on record, it is apparent that now all steps have been taken for not only establishing infrastructure but also ensuring distribution of medicines in terms of said scheme; also the Committee for procuring the medicines/equipments stands constituted. Learned counsel states that perhaps with the passage of time, the present petition has outlived its purpose, as such, it has become infructuous.

Since this is a public interest litigation, we are informed that perhaps Sri Brajesh Kumar, learned counsel

Patna High Court CWJC No.3095 of 2017(18) dt.18-02-2020 3/3 representing the petitioner, is no longer in active practice. As such, we close this proceeding as we are satisfied that cause highlighted by the writ petitioner stands redressed. However, we grant liberty to the petitioner or any of the public spirited person to approach the Court afresh, if need so arises.
