For the Petitioner/s : Mr. Jagdish Prasad Bhagat For the Opposite Party/s : Mr. Shahin Begum,APP ====================================================== CORAM: HONOURABLE THE CHIEF JUSTICE ORAL ORDER 16-01-2015 On a complaint submitted by the wife of the petitioner herein a case was registered by invoking provisions of Section 498A, 341, 323 and other relevant provisions of Indian Penal Code. The petitioner was arrested ten months back. He approached the court of 1st Additional Sessions Judge, Purnea by filing BP No. 469 of 2014. The same was rejected through order dated 20th August 2014. Hence this application.

Heard Mr. Jagdish Prasad Bhagat, learned counsel for the petitioner and Ms. Shahin Begum, learned APP. Except that the general allegations as of harassment are made, there is no specific overt act attributed to the petitioner. More than ten months have elapsed since the arrest of the

Patna High Court Cr.Misc. No.39253 of 2014 (2) dt.16-01-2015 2/2 petitioner. The complainant has stated that she is willing to live with the petitioner. It is stated that charge-sheet was already filed. Hence this application is allowed. Prayer for bail is granted. The petitioner shall be released on bail on furnishing bail bond of Rs.10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Samrendra Gandhi, Judicial Magistrate 1st Class, Purnea, in connection with Kasba PS Case No. 45 of 2014.

It is also directed that the petitioner shall live with his wife and lead a peaceful conjugal life.
