JUSTICE ASHUTOSH KUMAR ORAL ORDER 21-12-2018 The petitioner seeks bail in anticipation of his arrest in connection with Rautara P.S. Case No. 53 of 2018 dated 06.08.2018 instituted for the offences under Sections 147, 149, 341, 323, 379, 307, 504, 506 of the Indian Penal Code.

It has been alleged in the F.I.R that the cousin of the informant had been running a coaching centre where three boys of the area had made attempts to tease a girl. They were assaulted by the villagers and a Panchayati was also convened. During the course of Panchayati, a scuffle took place in which the petitioner and another are alleged to have pressed the neck of the informant.

The learned counsel for the petitioner has

Patna High Court Cr.Misc. No.72822 of 2018(2) dt.21-12-2018 2/2 submitted that there is no injury report on record and the informant has now settled the dispute with the petitioner and other accused persons and has expressed his unwillingness to prosecute them.

Regard being had to the nature of accusation as also taking into account the clean antecedents of the petitioner, the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, is directed to be released on bail on his furnishing bail bonds of Rs. 10,000/-(ten thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar in connection with Rautara P.S. Case No. 53 of 2018, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
