The matter has been taken up through video conferencing.

The petitioner seeks bail in Chanan P.S. case No. 127/2019 registered u/s 25(1-b) a, 26, 35 of Arms Act and u/s 16, 19, 20, 23 of U.A.P. Act.

The police apprehended two persons, namely, Dharmendra Koda, the petitioner, and Jay Nandan Yadav. It is alleged that the accused persons confessed that they are active members of Naxalite gang. On search, one live cartridge and three empty cartridges were recovered from the possession of the petitioner. One loaded country made pistol was recovered from Jay Nandan Yadav.

The learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.33343 of 2020(2) dt.15-12-2020 2/2 petitioner is in custody since 16.09.2019. Jay Nandan Yadav has already been granted bail vide order passed in Cr. Misc. No. 13532/2020 and the case of petitioner stands on same footing and the petitioner has got no criminal antecedent. Considering the facts aforesaid and the nature of allegation made against the petitioner, the petitioner, above named, is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Lakhisarai in connection with Chanan P.S. case No. 127/2019.
