The petitioners seek bail in Kotwa P.S. Case No. 142 of 2012, registered under Section 395 of the Indian Penal Code. The petitioners are not named in the F.I.R. The
Patna High Court Cr.Misc. No.39601 of 2014 (3) dt.17-04-2015 2 / 2 petitioners were apprehended in Bhatgaon P.S. Case No. 74 of 2012, in which they are alleged to have committed road robbery and also looted Sumo vehicle. The looted Sumo vehicle bearing Registration No. WB-20H 4308 was also recovered from possession of the petitioners. Bhatgaon police informed the S.H.O. of Kotwa Police Station and on such, confessional statement was recorded.
It is submitted by learned counsel for the petitioners that the petitioners have already been enlarged on bail in Bhatgaon P.S. Case No. 74 of 2012. The petitioners were not put on T. I. P. in the present case. The petitioners are in jail since 03.06.2014. Considering the facts aforesaid, the petitioners above named, are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., East Champaran at Motihari, subject to the condition that one of the bailors shall be local people having substantial immovable property.
