JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 06-04-2021 Heard learned counsel for the petitioner and the learned A.P.P. for the State, through Video Conferencing. The petitioner apprehends his arrest in connection with Kajra P.S. Case No.38 of 2020 registered under Section 420 of the Indian Penal Code besides Section 7 of the E.C. Act. The accusation is that the petitioner being the PDS Shop Dealer supplied the less quantity of rice and wheat to the card-holders.

Learned counsel for the petitioner submits that it would appear from the F.I.R. and the case diary that the only allegation against the petitioner is to supply the less quantity of rice and wheat to the card-holders connected with the PDS shop of the petitioner. Patna High Court CR. MISC. No.32090 of 2020(4) dt.06-04-2021 2/2 appearing for the petitioner, submits at the Bar that after lodging of the present case, the license of the PDS shop of the petitioner has already been cancelled.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Lakhisarai, in connection with Kajra P.S. Case No.38 of 2020, subject to the conditions laid down under Section 438(2) Cr.P.C.
