Mr. Manoj Kumar Sinha, AC to SC- 19 ====================================================== CORAM: HONOURABLE MR. JUSTICE MADHURESH PRASAD ORAL ORDER 29-08-2023 Heard learned counsel for the petitioner and learned counsel for the State.
2.
Petitioner's grievance, now after filing of the two interlocutory applications in the instant writ proceedings, which was originally filed challenging the suspension order, is that though he has submitted his response to the second show-cause notice on 28-04-2022, as per Annexure- IA- 16, final order has not been passed in the proceedings.
3.
In view of this limited grievance, and since final order is to be passed by the Disciplinary Authority, namely, District
Patna High Court CWJC No.13438 of 2021(3) dt.29-08-2023 2/2 Magistrate, Vaishali at Hajipur, writ petition need not be kept pending, as there is no adjudication called for in the instant writ proceedings.
4.
If final order has not been passed in the departmental proceedings, in the instant case arising out of order dated 24-102016, bearing Memo No. 1951 (Annexure- 1), issued by the District Magistrate, Vaishali at Hajipur, then the same is required to be passed expeditiously without any undue delay and in accordance with law within a period of eight weeks from the date of receipt/production of a copy of this order. 5.
Accordingly, writ petition is disposed of.
