2. The petitioner seeks regular bail in connection with S. Tr. No. 502 of 2023, G.R. No. 65 of 2023 arising out of Jaynagar P.S. Case No. 24 of 2023, lodged on 16.01.2023 under Sections 304(B) & 34 of the Indian Penal Code, pending before the Court of District & Additional Sessions Judge- XII, Madhubani.

3. Learned counsel for the petitioner submits that the bail application of the petitioner was earlier rejected vide order dated 09.04.2024 passed in Cr. Misc. No. 8127 of 2024 with a liberty granted to the petitioner that if the trial shall not be concluded within 9 months, the petitioner may renew his prayer for bail after 9 months.

4. Counsel further submits that nine months have already passed, but all prosecution witnesses have not been examined till date and the trial has not been concluded. He also submits that on the previous occasion, a report regarding the present stage of the trial was called for.

5. Learned APP for the State opposes the prayer for bail and submits that a report was called for, and from the said report it transpires that charge has been framed on 08.01.2024 and 07 witnesses have been examined out of 13 prosecution witnesses. It further transpires from the report that the trial may be concluded within 09 months.

6. In the present facts and circumstances of this case and the submissions made above, this Court is not inclined to grant bail to the petitioner. Therefore, the bail application of the petitioner is hereby rejected.
