2. The petitioner is apprehending arrest in connection with Mahindwara P.S. Case No. 11 of 2025, dated 19.01.2025, lodged under Sections 329(4), 115(2), 118(1), 76, 352 and 3(5) of the Bhartiya Nyaya Sanhita, 2023 (hereinafter referred to as "BNS, 2023"), pending before the Court of Judicial Magistrate 1st Class, Sitamarhi.

3. As per the prosecution, FIR has been lodged against four named accused persons, including the present petitioner, with the allegation that all the accused assaulted the informant and his family members, causing them injuries.

4. After some argument, learned counsel for the petitioner submits that the present petitioner has been granted the benefit of Section 41 of the Cr.P.C. / Section 35 of the BNSS. As such, he submits that there is no immediate apprehension of arrest of the petitioner. Accordingly, at present, he seeks permission to withdraw the present bail application, with liberty to move for anticipatory bail as and when the situation arises.

5. Learned counsel for the State has no objection for the same.

6. Permission, as prayed for, is granted.

7. Accordingly, the present bail application stands disposed off with the aforesaid liberty.
