JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-01-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 23.5.2014 in a case registered for the offences punishable under Sections 394 and 302 of the Indian Penal Code.

The informant's husband was robbed and killed by the miscreants.

It is submitted by learned counsel for the petitioner that the name of the petitioner sprang up during investigation when a broken mobile was seized from the place of occurrence of which SIM was ultimately found to be registered in the name of Manoj Sah, husband of Archana Devi. Archana Devi Suggested that the petitioner being her nephew was using the said mobile. Considering the fact that SIM and the mobile were registered in the name of Manoj Sah, there is nothing against the

No.40868 of 2014 (3) dt.22-01-2015 petitioner except confession of Archana Devi before the police, the petitioner has not been put on test identification parade and statement made in paragraph 3 of the petition that the petitioner has no criminal antecedent, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Purnea in connection with Purnea Sadar P.S. Case No.176 of 2014.
