The petitioner seeks bail in anticipation of his arrest in connection with Nalanda P. S. Case No. 190 of 2019, dated 26.12.2019, instituted for the offence under Section 30(A) of the Bihar Prohibition and Excise Act, 2016.

Patna High Court CR. MISC. No.33080 of 2020(2) dt.09-03-2021 2/3 1260 litres of liquor is said to have been recovered from a vehicle and the implication of the petitioner in the present case is on the statement of one Bipin Gupta who was arrested at the time of raid. There is no recovery from the petitioner and he has got no concern with the affairs of aforesaid Bipin Gupta. The petitioner was earlier made accused in three cases of minor nature but those cases were instituted on one day with respect to same transaction and in all those cases, the petitioner has been granted bail. None of those cases relate to Bihar Excise Act. Considering the afore-stated facts, the petitioner, above-named, is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate,
