The petitioner, who is the grandson of the deceased, seeks bail in connection with Dalsingsarai P.S. Case No. 162 of 2019, dated 01.07.2019, corresponding to Sessions Trial No. 596 of 2019, instituted for the offences under Sections 302 and 34 of the Indian Penal Code.

The postmortem does not reveal any external injury on the person of the deceased. It appears that two of the daughter-in-laws of the deceased fought among themselves and one of them has alleged the act of assault against the other deceased, who is the father-in-law of the informant as well as the mother of the petitioner.

The petitioner is in custody since 26.07.2019. The mother of the petitioner, viz., Batorni Devi, has been granted bail by a Bench of this Court vide order dated 05.03.2020 passed in Cr. Misc. No. 9148 of 2020. Regard being had to the aforestated facts, the petitioner above-named is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge, Dalsingsarai, Samastipur in connection with Dalsingsarai P.S. Case No. 162 of 2019, corresponding to Sessions Trial No. 596 of 2019.

No.25957 of 2020(2) dt.13-10-2020 3/3 However, it is made clear that the petitioner shall participate in the trial proceedings and shall not absent himself without any plausible reason and without obtaining the permission of the Trial Court. Should he do so on two consecutive occasions, it would be open for the Trial Court to cancel his bail.

With the aforesaid observation/direction, the application stands allowed.
