25-03-2015 Heard Sri Umesh Chandra Verma, learned counsel for the petitioner and Mr. Md. Ansural Haque, learned Addl. Public Prosecutor.

This is the second attempt for grant of bail to the petitioner in connection N.D.P.S. Case No.43 of 2012 arising out of Raxaul P.S. Case No.83 of 2012 registered for the offence under Sections 20, 22, 23 and 24 of the N.D.P.S. Act. Earlier on 30.10.2013, the prayer for grant of bail was rejected vide Cr.Misc.No.29864 of 2013 on the ground that huge quantity of Ganja to the tune of 210 Kg. was recovered.

Learned counsel for the petitioner submits that after rejection of the bail petition, out of eight chargesheeted witnesses

Patna High Court Cr.Misc. No.40122 of 2014 (4) dt.25-03-2015 2/2 five witnesses have already been examined.

Keeping in view the fact that evidence is going on, there is no ground to review my earlier order. However, keeping in view the fact that the petitioner is in custody since 16.04.2012, it is desirable to observe that the learned trial court may take appropriate steps, so that trial may come to its logical end without unnecessary delay.
