JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 01-04-2015 Heard learned counsel for the petitioner as well as learned APP for the State.
There happens to be specific disclosure against the petitioner to have inflicted repeated Chhura blows over deceased, Rakesh Raushan and during course thereof, he also gave Chhura blow over informant, Babita Devi. Other accused persons so named have also been found indulged actively in the said occurrence. Furthermore, it has also been alleged that husband of informant was also assaulted and sale proceeds amounting of Rs. 68,500/- was also snatched. The allegation is found corroborated with the postmortem report available in the case diary along with injuries as coming out from the injury report relating to informant Babita Devi wherein injuries no. 3 to 5 are said to be caused by sharp cutting weapon.
Patna High Court Cr.Misc. No.38976 of 2014 (5) dt.01-04-2015 Consequent thereupon, I do not see it a fit case for grant of bail. Prayer for bail is rejected.
