2. The petitioner has preferred this application for grant of regular bail in connection with Jhanjharpur P.S. Case No. 205 of 2023 dated 10.11.2023 registered for the offences punishable u/s 394 of the Indian Penal Code.

3. As per the prosecution case, on 10.11.2023 the informant withdrew Rs. 78,000/- from SBI, Jhanjharpur Branch and he was walking towards the tempo stand, suddenly two miscreants loaded on motorcycle came and snatched the informant's bag containing the said withdrawal amount from the bank.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in

Patna High Court CR. MISC. No.35289 of 2024(2) dt.16-05-2024 2/2 this case. The petitioner is not named in the F.I.R. and the name of the petitioner has transpired in this case merely on the basis of the suspicion. It is further submitted that no T.I.P has been conducted in this case. There is general and omnibus allegation against the petitioner. No incriminating article has been recovered from the conscious possession of the petitioner. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 17.11.2023.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case, nature of allegation levelled against the petitioner and the period of custody, the petitioner above-named, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Madhubani in connection with Jhanjharpur P.S. Case No. 205 of 2023.

7. The application stands allowed.
