The petitioners seek bail in anticipation of their arrest in connection with Madhuban P.S. Case No. 77 of 2018 dated 25.05.2018 instituted for the offences under Sections 147, 148, 149, 341, 323, 307, 427, 504 and 506 of the Indian Penal Code.
Patna High Court CR. MISC. No.32579 of 2020(2) dt.19-02-2021 2/3 The accusation against the petitioners is of assaulting the informant and members of his family. The specific act of tying the neck of the informant is on petitioners no. 3 and 4, who is said to have received corresponding injuries.
Learned counsel for the petitioners has submitted that the entire allegation is false and concocted. In fact, the petitioners are in possession of the land on the basis of auction-sale certificate. The petitioners are the heirs of the auction purchaser. Though the impugned order reflects that the informant has received serious injuries but the dimension of the injuries have not been stated in the impugned order. Regard being had to the background facts of the case and the nature of accusation the petitioners are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of eight weeks from the date of receipt/production of a copy of this order, on their

Case No. 77 of 2018, subject to the conditions as laid down under Section 438(2) Cr.P.C.
