The petitioner has been in custody since 24.02.2020 in connection with Obra P.S. Case No. 39/2020 registered for the offense punishable under Sections 302/34 of the Indian Penal Code.

As per the prosecution case, on 12.02.2020, while the informant was going to Samudayik Bhawan, this petitioner along with co-accused Sanju Choudhary caught his brother Sunil Kumar and other co-accused persons stabbed him resulting into his death during the course of treatment. It is submitted that allegation of stabbing is on other coaccused and the petitioner has only caught hold of the deceased.

Patna High Court CR. MISC. No.32766 of 2020(3) dt.07-12-2020 2/2 Petitioner is in custody since 24.02.2020. Chargesheet has already been submitted in this case.

Considering the aforementioned facts and circumstances, the bail application of this petitioner is allowed. Let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Daudnagar, Aurangabad, in connection with Obra P.S. Case No. 39/2020.
