None appears on behalf of the opposite party no. 2. This application has been filed for quashing the order dated 07.12.2016 by which learned Magistrate has taken cognizance against the petitioners in Complaint Case No. 819/2015 registered for the offence under section 3/4 of the Dowry Prohibition Act.

The petitioners have challenged the complaint case showing that F.I.R. is also pending.

This application is disposed of with a liberty to the petitioners to file an application under Section 210 of the Cr.P.C.

Patna High Court CR. MISC. No.73916 of 2018(3) dt.01-05-2023 2/2 and the court below will pass an order in accordance with law on the petition filed by the petitioners or if any such application is pending by the petitioners.
