2. The petitioner has prayed for bail in connection with Areraj P.S. Case No. 29 of 2025 registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise (Amdt.) Act , 2022.
3. The case of the prosecution is that two persons on a bike were carrying a sack. They started fleeing away seeing the police. One person managed to escape. Other person was apprehended and from that sack, altogether 60 liters of country made liquor was recovered. The name of this petitioner was disclosed by the apprehended person.
4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this
Patna High Court CR. MISC. No.32719 of 2025(2) dt.22-05-2025 2/2 case. He was not apprehended on the spot and nothing has been recovered from his possession. He is having criminal antecedent of one case in which he is on bail. He is in judicial custody since 16.02.2025.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Court No.1, Civil Court, East Champaran, Motihari in connection with Areraj P.S. Case No. 29 of 2025.
