The petitioner seeks regular bail in connection with Bhimpur P.S. Case No. 87 of 2022, registered for the offences punishable under Sections 366 (A) of the Indian Penal Code and 8/17 of the POCSO Act.

As per the allegation, it is alleged that the petitioner has abducted the minor daughter of the informant with an intention to marry her.

Learned counsel for the petitioner submits that the petitioner has not committed any offence as alleged and the victim girl in her statement under Section 164 Cr.P.C. has herself stated about the love affairs with the petitioner and she herself eloped with the petitioner and solemnized her marriage

Patna High Court CR. MISC. No. 33434 of 2023(2) dt.24-06-2023 2/2 at her own sweet will. Petitioner has not done any overt act. Petitioner has no criminal antecedent and is in jail custody since 03.01.2023.

Learned APP for the State has opposed the prayer for regular bail of the petitioner.

Considering the facts and circumstances of the case let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate- VI, Supaul in connection with Bhimpur P.S. Case No. 87 of 2022.
