Heard learned counsel for the petitioner and the learned APP for the State.
Petitioner seeks regular bail in connection with Katihar Muffasil P.S. Case No. 212 of 2017 registered for the offence punishable under Section 304(B)/34 of the Indian Penal Code.
As per the prosecution, the informant's sister was married to this petitioner in the year 2015 thereafter it is alleged that the deceased was regularly being tortured for demand of dowry and further it is alleged that on the alleged date this
Patna High Court CR. MISC. No.33786 of 2022(3) dt.13-02-2023 2/3 petitioner along with other co-accused persons killed the informant's sister for non-fulfillment of the said dowry demand. The main submissions advanced by the learned counsel Mr. Ajit Kumar Singh for the petitioner are that offenly he worked in other State Assam and during investigation the said fact was supported by some of the witnesses and it also came into light in the statement of some other witnesses that on account of some money dispute in between the petitioner and deceased, the deceased herself consumed poison and committed suicide and in this regard the police official's supervision note in the case diary may be perused. Further submission is that the petitioner has been languishing in jail since 18.01.2022 and there is no specific allegation of dowry demand against him and the alleged offence under section 304(B) of IPC does not attract in this case.
Learned APP Dr. Ajeet Kumar appearing for the State has opposed the bail prayer.
Considering the above submissions which get support from the case diary and also taking into account the period of custody of the petitioner, this court is inclined to accept the prayer for bail, let the petitioner be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two
Patna High Court CR. MISC. No.33786 of 2022(3) dt.13-02-2023 3/3 sureties of the like amount each to the satisfaction of the concerned Court in connection with Katihar Muffasil P.S. Case No. 212 of 2017.
