The petitioner is apprehending his arrest in a case registered for the offence punishable under Section 30 (a) of Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that alleged recoveries were not from the conscious possession of the petitioner but from nearby hut. The co-accused has been granted anticipatory bail by the Coordinate Bench of this Hon'ble Court in Cr. Misc. 34059 of 2019 dated 23.05.2019.

In the aforesaid facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt of the order, be released on anticipatory

Patna High Court CR. MISC. No.36052 of 2019(3) dt.13-08-2019 2/2 bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Sarai P.S. Case No. 33 of 2019 to the satisfaction of the learned Additional Sessions Judge, 2nd cum Special Judge, Excise, Hajipur at Vaishali, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
