The petitioner seeks bail in Jamui Police Station (for brevity, PS) Case No 496 of 2019 (GR No 2670 of 2019) instituted for the offence punishable under Sections 341, 323, 354B, 504, 385/34 of Indian Penal Code.

There is allegation against the peptitioner that the accused persons attempted to construct a wall in front of the petitioner;s house. An objection being raised, the daughter of the informant has been assaulted and the petitioner has tried to outrage her modesty.

petitioner's counsel submits that the subsisting land dispute between the parties is the basis of petitioner's false

Patna High Court CR. MISC. No.31309 of 2020(3) dt.01-02-2021 2/2 implication. No such occurrence has taken place. The learned APP for the State submits that several witnesses have supported the allegation against the petitioner as it has come in the investigation.

This Court, after considering the submissions of the rival parties, is not inclined to allow the prayer for anticipatory bail. The same is rejected.

Learned counsel for the petitioner is expected to honour his undertaking given in the instant proceedings today for depositing requisite Court fee and removing the defect (s), as pointed out, when called upon to do so.
